Reference: Fatal Motor Vehicle Accident

On Friday, November 26th, 2004, at 4:47pm, Portsmouth Police and Fire Departments responded to a motor vehicle accident in the area of 1363 Islington Street.

The accident involved a 1998 Ford F-150 Pick up truck operated by Kevin J. Rogers age 39 of Main Street in Epping, New Hampshire and a Pedestrian named Jacqueline Murray age 73 of Islington Street, Portsmouth, New Hampshire.

The Portsmouth Police Department in conjunction with the Rockingham County Attorney's Office has concluded this investigation. Jacqueline Murray was walking and crossing Islington Street wearing dark clothing outside of a crosswalk at the time of the crash. The driver of the Pick up truck stated he did not see Mrs. Murray crossing the road and struck her. A Nurse who was passing by stopped immediately and attempted emergency CPR followed by rescue personnel of the Portsmouth Fire Department however Mrs. Murray did not survive and was pronounced dead at the scene.

The driver submitted to a voluntary blood test which was analyzed at the State Lab. Extensive traffic accident reconstruction of the scene and follow up forensic exams by the NH State Police Laboratory aided our investigative findings. At the time of the accident the area was dark as night had fallen and there was little overhead street lighting.

The investigative results showed the truck not to be traveling in an criminal manner. The was NO drug or alcohol involvement. Several witness did come forward and aided greatly in helping the investigators reconstruct this accident. Many other aspects of this accident have been reviewed including but not limited to things such as pedestrian error, possible driver fatigue, poor visibility on a darkened roadway, etc.

The County Attorney's Office and the Portsmouth Police Department do not find the driver of the truck to have been driving in a criminally liable way. There will be no criminal charges filed.
